Product Disclaimer and Limitation of Liability

Acon Advertising LLC (“Carlos Contreras”) is an authorized dealer of Puronics Water Systems Inc and related water filtration products (“the Products”). The Products sold by Acon Advertising LLC are manufactured by independent third parties, including Puronics Water Systems Inc.

Acon Advertising LLC
Acon Advertising LLC does not design, manufacture, or test the Products. They are provided strictly “as is” and “as available”, without any warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, performance, durability, or non-infringement. Any warranties or guarantees that may apply are provided solely by the manufacturer. Customers are solely responsible for reviewing and relying on manufacturer warranty terms.
Limitation of Liability
To the fullest extent permitted by law, Acon Advertising LLC, including its owners, affiliates, employees, and contractors, shall not be liable for any damages or losses of any kind arising out of or related to the purchase, installation, maintenance, operation, or use of the Products. This includes, without limitation, damages for:
People damage, property damage, fire damage, water damage, or flooding
- Mold, corrosion, or contamination
- Equipment failures or malfunctions
- Personal injury or health impacts
- Business interruption, loss of profits, or incidental/consequential damages
- Act of God or Nature.
This limitation applies even if Acon Advertising LLC was advised of the possibility of such damages.
Indemnification
The Customer agrees to indemnify, defend, and hold harmless Acon Advertising LLC, its affiliates, owners, employees, and contractors against any claims, demands, liabilities, damages, or expenses (including attorneys’ fees) resulting from or related to the purchase, installation, maintenance, use, or misuse of the Products. This includes, but is not limited to, leaks, malfunctions, failures, neglect, unauthorized alterations, or non-compliance with manufacturer instructions.
Customer Responsibility
The Customer is solely responsible for ensuring that Products are:
Installed in compliance with manufacturer guidelines, building codes, and applicable laws.
Professionally installed and serviced by qualified technicians (strongly recommended).
Regularly maintained to ensure proper functioning and to reduce risks of leaks, failures, or damage.
Improper installation, neglect, or failure to follow manufacturer guidelines may void all manufacturer warranties and fully release Acon Advertising LLC from any liability.
Acknowledgment of Risk
By purchasing or using the Products, the Customer acknowledges and accepts that all water treatment equipment carries inherent risks, including leaks, pressure failures, water damage, or malfunctions. The Customer voluntarily assumes all such risks and waives any claims against Acon Advertising LLC arising from them.
Dispute Resolution
This Disclaimer shall be governed by and construed under the laws of the State of Arizona, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.
Agreement to Terms
By purchasing or using the Products, the Customer confirms that they have read, understood, and agree to this Disclaimer and Limitation of Liability. If the Customer does not agree, they must not purchase or use the Products.
